By accessing or using Diets.com.sg ('DCS'), you agree to be bound by the terms and conditions of this agreement (the 'Agreement'). DCS may modify this Agreement at any time, and such modification shall be effective immediately upon either posting of the modified Agreement or notifying you. Your continued access or use of DCS after any such modification shall be deemed your conclusive acceptance of the modified Agreement. You can access this Agreement at any time from the bottom of any page of the DCS site. If you do not agree to abide by this Agreement, do not use the site or download materials from the site.

COPYRIGHT: All information used and displayed on the DCS site or in email messages, including but not limited to text, software, photographs, graphics, illustrations and artwork, video, music and sound, and names, logos, trademarks and service marks (the 'content'), are the property of DCS or its affiliates or licensors and are protected by worldwide copyright, trademark and other laws. Subject to the terms and conditions set forth in this Agreement, DCS grants you a non-exclusive, non-transferable, limited right to access, view and download the information on the Site only for your personal, non-commercial use.

You acknowledge that you do not acquire any ownership rights by downloading copyrighted material. You may not modify, publish, transmit, display, participate in the transfer or sale, create derivative works, or in any way exploit the content available on or through the DCS site, except as otherwise expressly permitted under copyright law or with the express permission of DCS and the copyright owner.

GENERAL DISCLAIMER: All information presented by DCS is for educational purposes only. The material is not intended to be instructional for medical diagnosis or treatment, and should not be a substitute for medical counselling. DCS may make any other changes to the Site, the materials and the programs, services or prices (if any) described in the Site at any time without notice. DCS does not warrant or guarantee that the functions or services performed in the Site will be uninterrupted or error-free or defects in the Site will be corrected.

USER REPRESENTATIONS: You represent and warrant that the information you provide to DCS is truthful and accurate. You also represent and warrant that you are at least 18 years of age and that you possess the legal right and ability to enter into this Agreement and to use DCS in accordance with this Agreement. You agree to be financially responsible for your use of DCS and to comply with your responsibilities and obligations as stated in this Agreement.

MEMBERSHIP: By becoming a DCS member, you agree that DCS, in its sole discretion, may disclose current or past information about members when it has a good faith believe that: (1) the law requires disclosure; (2) a member has violated the law or the terms of this agreement; or (3) DCS deems disclosure necessary or appropriate to operate its site or its services.

Unless otherwise offered, all new memberships are for a minimum twelve (12) weeks prepaid subscription. Upon fulfillment of your subscription, DCS members may continue using our program in 4-week prepaid subscriptions or cancel. Cancellations are not retroactive and prepaid subscriptions are non-refundable. Cancelled accounts will be deactivated on the day following the last day of the subscription. Once cancelled, a DCS account cannot be reactivated. All memberships are non-transferable. Under extenuating circumstances, refunds are at the discretion of management.

You agree to maintain the security of your user identification, password and other confidential information relating to your DCS account. You agree not to interrupt or attempt to interrupt the operation of the Site in any way.

DCS reserves the right to refuse membership for any reason, including certain medical conditions.

INDEMNIFICATION: You agree to indemnify, hold harmless, and defend DCS, and its officers, directors, employees, agents, affiliates, content providers, and suppliers, against any and all claims, liabilities, damages, costs and expenses including legal fees, injuries, losses or damages of any kind to persons, including illness, death, or property, resulting from any violation of this agreement or any activity related to your account by you or any other person accessing DCS using your account.

WAIVER, RELEASE AND LIMITATION OF LIABILITY: You agree that neither DCS, nor its officers, directors, employees, agents, information providers or suppliers, shall have any liability to you under any theory of liability or indemnity in connection with your use of DCS. You hereby release and forever waive any and all claims you may have against DCS, its officers, directors, employees, agents, information providers or suppliers for losses or damages you sustain in connection with your use of DCS.

Notwithstanding the foregoing paragraph, the total liability of DCS and its officers, directors, employees, agents, information providers and suppliers, if any, for losses or damages shall not exceed the fees paid by you for the particular information or service provided. All other damages, direct or indirect, special, incidental, consequential or punitive arising from any use of the information or other parts of DCS are hereby excluded even if DCS or its officers, directors, employees, agents, information providers or suppliers have been advised of the possibility of such damages.

DISCUSSION BOARDS AND CHAT ROOMS: You acknowledge that if you participate in our Community you will abide by the community standards. Our full community standards is available at the Community page.

SYSTEM REQUIREMENTS: Members must have a PC or Macintosh computer, an Internet connection, and a printer. Members must provide a valid email address that will be used for the duration of the program. DCS assumes no responsibility for computer systems, hardware, software or program malfunctions or for other errors, failures, or delays in computer transmissions or network connections that are human or technical in nature or for lost, late, mutilated, illegible, postage-due, incomplete or misdirected information. DCS reserves the right, in its sole discretion, to cancel or suspend this program should virus, bugs, or other causes beyond DCS's control corrupt the administration, security or proper function of this program.

LINKS TO OTHER SITES: DCS may provide, on the Site, links to Web sites operated by other persons or entities. If you decide to visit any linked site, you do so at your own risk. DCS does not endorse and accepts no responsibility for any representations, warranties, terms, conditions, payment, or delivery of any goods or services of a linked sites or the information appearing therein or any of the products or services described thereon.

TERMINATION: DCS reserves the right to terminate or suspend your DCS membership without prior notice, but DCS will attempt to confirm such termination or suspension by subsequent notice. Where the termination is based on just cause, there will be no refund.

MISCELLANEOUS ITEMS: The Site is controlled, operated and administered by Diets.com.sg from its offices within Asia. Diets.com.sg makes no representation that materials at Diets.com.sg are appropriate or available for use outside of the region.
